END USER LICENSE AGREEMENT, TERMS OF SERVICE, AND PRIVACY POLICY

IMPORTANT — READ CAREFULLY: This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and the developer of PulseTuner ("Licensor") for the software product identified above. By acquiring, downloading, installing, or otherwise using PulseTuner, you agree to be bound by the terms of this EULA. If you do not agree, do not install or use the Software.

1. License Grant

Licensor grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Software strictly in accordance with the terms of this Agreement. This Software is licensed, not sold.

2. System Modifications and Assumption of Risk

PulseTuner includes advanced features (such as "Beast Mode" and the autonomous "AI Mechanic" powered by our on-device PT AI engine) designed to modify operating system behaviors, manage system resources, and optimize hardware performance.

  1. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE SOFTWARE IS AT YOUR SOLE RISK.
  2. The Licensor does not guarantee that the Software will not cause system instability, crashes, or data loss.
  3. You are strongly advised to back up all personal data before utilizing the Software's optimization features.

3. Privacy and Data Collection

To enforce trial periods and license validations, PulseTuner generates and transmits a securely hashed "Machine ID" derived from your CPU model, Motherboard serial number, and Disk Drive serial number.

  1. This Machine ID contains no personally identifiable information (PII) and cannot be reverse-engineered to identify you personally.
  2. PulseTuner does NOT collect, monitor, or transmit your personal files, browsing history, keystrokes, or any document content.
  3. PulseTuner reads local system telemetry (CPU temperature, CPU and RAM usage, running process names, disk health, installed driver versions, battery status) solely for the autonomous AI Mechanic to make local optimization decisions on your device. This telemetry is never transmitted off your device.
  4. PT AI engine memory, learned patterns, performance diary entries, and action history are stored locally on your device only, in %APPDATA%\.pulsetuner\. They are never uploaded or shared.

4. Subscriptions and Billing

PulseTuner provides a fully functional 7-day free trial. Premium license subscriptions are processed via our external, secure Merchant of Record (Lemon Squeezy). PulseTuner does not locally collect, process, or store your credit card data or billing addresses.

5. Restrictions

You may not:

  1. Decompile, reverse engineer, disassemble, or attempt to derive the source code of the Software.
  2. Bypass, modify, or defeat any of the Software's licensing, trial tracking, or hard paywall mechanisms.
  3. Distribute, rent, lease, or sublicense the Software without explicit permission.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, HARDWARE DAMAGE, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

By downloading, installing, or using the Software from the Microsoft Store, our official website, or any other authorized distribution channel, you acknowledge that you have read this agreement, understand it, and agree to be bound by its terms and conditions.
